Account Creation

To access certain features, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate and current
• Maintain the security and confidentiality of your login credentials
• Notify us immediately of any unauthorized access or security breach
• Accept responsibility for all activities that occur under your account

Account Security

You are solely responsible for maintaining the confidentiality of your account credentials. You agree not to share your account with others. We are not liable for any loss or damage arising from your failure to protect your account information.

Subscription Tiers

We offer various subscription plans with different features and pricing. Current plan details are available on our website. We reserve the right to modify our subscription plans, pricing, and features at any time.

Payment Processing

All payments are processed securely through Stripe, a third-party payment processor. We do not store or process your payment card information on our servers. By making a purchase, you agree to Stripe's terms of service and privacy policy.

Billing and Automatic Renewal

• Subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled
• You will be charged the then-current rate for your subscription plan
• We will notify you of any price changes before your next billing cycle
• You authorize us to charge your payment method on a recurring basis
• All fees are non-refundable except as required by law or as explicitly stated in our refund policy

Cancellation

You may cancel your subscription at any time through your account settings or by contacting support@scribeist.com. Cancellations take effect at the end of your current billing period. You will retain access to paid features until the end of the paid period.

After cancellation, your account will revert to a free plan (if available) or be subject to data retention policies outlined in our Privacy Policy.

Refund Policy

Generally, all fees are non-refundable. However, we may provide refunds at our sole discretion in cases of:

• Service outages or significant technical issues
• Duplicate charges or billing errors
• Requests made within 7 days of initial purchase for annual plans

Failed Payments

If a payment fails, we will attempt to charge your payment method again. If payment continues to fail, we may suspend or downgrade your account. You are responsible for any fees charged by your payment provider due to failed payment attempts.

Taxes

You are responsible for any applicable taxes, duties, or government charges. We will collect such amounts if required by law.

Your Ownership of Content

You retain full ownership and all intellectual property rights to any content you create, upload, or store on our Service ("User Content"). This includes manuscripts, stories, notes, outlines, and any other creative work.

We do not claim any ownership rights to your User Content. Your creative work is yours, and using our Service does not transfer any ownership to us.

License Grant to Scribeist

By using our Service, you grant us a limited, non-exclusive, royalty-free, worldwide license to:

• Store, host, and backup your User Content on our servers
• Display your User Content to you across your devices
• Process your User Content to provide Service features (e.g., word counts, analytics)
• Transmit your User Content to third-party AI services when you explicitly activate AI features
• Make technical copies necessary to operate and maintain the Service

This license exists solely to enable us to provide the Service and terminates when you delete your User Content or close your account, subject to reasonable retention periods for backups.

AI-Generated Content

When you use optional AI features, any content generated by AI ("AI Output") is assigned to you by our third-party AI providers, subject to their terms and applicable law. You retain ownership of AI Output. For more details, see our AI Usage Policy.

Scribeist's Intellectual Property

All aspects of the Service, including but not limited to the website design, software, logos, trademarks, features, and functionality, are owned by or licensed to Scribeist and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless expressly permitted by law or with our written permission.

User Representations

You represent and warrant that:

• You own or have the necessary rights to all User Content you upload
• Your User Content does not infringe on the intellectual property or other rights of any third party
• You have obtained all necessary permissions, licenses, or consents for any third-party content

Prohibited Activities

• Violate any applicable laws, regulations, or third-party rights
• Upload or transmit malware, viruses, or malicious code
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or servers
• Use automated tools (bots, scrapers) without permission
• Engage in any activity that imposes unreasonable load on our infrastructure
• Reverse engineer, decompile, or disassemble any part of the Service
• Remove or modify any copyright, trademark, or proprietary notices
• Use the Service to harass, abuse, or harm others
• Impersonate any person or entity or falsely state your affiliation
• Share your account credentials or allow unauthorized access
• Sell, rent, or lease access to your account or the Service
• Use the Service to store or distribute illegal content

Content Restrictions

While we respect creative freedom, you may not upload or store content that:

• Infringes on intellectual property rights
• Contains child sexual abuse material (CSAM)
• Violates privacy rights or contains unauthorized personal information
• Is used to facilitate illegal activity

Termination by You

You may terminate your account at any time by:

• Using the account deletion option in your settings
• Contacting support@scribeist.com

You should export your User Content before deleting your account, as deletion is permanent.

Termination by Scribeist

We may suspend or terminate your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Non-payment of fees
• At our discretion if we believe termination is necessary to protect our Service, users, or interests

Effect of Termination

Upon termination:

• Your right to access and use the Service immediately ceases
• We may delete your User Content in accordance with our data retention policies
• You remain liable for all fees and charges incurred prior to termination
• Sections of these Terms that by their nature should survive termination will survive (including ownership provisions, warranty disclaimers, indemnity, and limitations of liability)
